SBA Proposes WOSB Rule to Expand Access to Federal Contracting Opportunities

The SBA has released a proposed rule targeted towards expanding federal contracting opportunities for women-owned small business (WOSB).

It identifies 83 industries and is aimed at providing greater opportunities for WOSBs to compete for federal contracts, while achieving the existing statutory goal that 5 percent of federal contracting dollars go to WOSBs. This proposed rule is available until close of business May 3, 2010.

White House Targets Tax Delinquent Federal Contractors

The Obama administration on Wednesday announced plans to crack down on federal contractors that fail to pay their taxes, part of the White House's continuing efforts to save taxpayer dollars by cutting wasteful government contracts.

An executive order signed by President Obama directs the Office of Management and Budget and Treasury Department to block tax-delinquent contractors from receiving new work from federal agencies. The Internal Revenue Service will also review the accuracy of contractors' tax returns to ensure truthful reporting. Read more...

Protest An Option?

Many government contracts are awarded with a base year and one or more one year options.  Typical types of contracts are for services (such as grounds maintenance, custodial/janitorial services, housing maintenance, etc.) awarded for one base year, plus four one year options, which can be exercised at the option of the Government.  FAR 52.217-9, Option to Extend the Term of the Contract (March 2000), states that the "Government may extend the term of this contract by [taking actions to exercise the options]."  Usually this entails a preliminary notice sent to the contractor but that in itself does not commit the Government to an extension.  Many vendors get upset when the Government does not exercise an option and try to protest the fact that they didn't receive that work.  The law is very clear that options are included for the benefit of the Government and unless there is an express limitation in the contract, contractors have no recourse for the Government's failure to exercise an option. PTAC Client Success Stories

Carolina Management Team

Carolina Management Team (CMT) is a painting contractor that provides full-service, on-site protective coating solutions primarily in North Carolina.  They apply high-performance, industrial coatings in water and wastewater facilities, as well as in manufacturing environments.  In 2008, owners Wendy Banks and her brother David Van Zee were named SBA’s Small Business Persons of the Year.  Carolina Management Team has been an SBTDC client since 2004.

In March, CMT began a project valued at over $1 million at the water treatment facility in Goldsboro, NC.  In addition, the client was interested in obtaining more in-depth financial insight. Their PTAC counselor connected CMT with Western Carolina University professor of finance Bob Carton, PhD.  With his assistance, the company was successful in obtaining bonding up to nearly $2 million. “That meeting with Bob was the biggest home run of 2009 for CMT.  Just wish I had sought your recommendations sooner,” said owner Wendy Banks.  “Thank you for staying in touch with our little company.”

Guerrero Builders

Guerrero Builders is a construction company that does residential, commercial, and industrial buildings.  They are a general contractor and their work includes masonry, concrete, flooring, painting, dry wall, siding, and roofing.  They also do maintenance work, janitorial services, and facility support

  I had received an email from a couple of Large Businesses looking for small business subcontractors and from The Army Corps of Engineers, Norfolk VA with a link for a sources sought SDVOSB construction possibility.  They requested we send this link to our SDVOSB construction clients with design/build capabilities. 

I verified that Mr. Guerrero was a SDVOSB and then checked his CCR, SBA profile, and ORCA for currency.  Mr. Guerrero's ORCA was about to expire on Apr 28, 2010 so I alerted him to revalidate it before it expired.  I also indicated that he should respond to the sources sought requirement if he was interested in bidding on the solicitation when it is issued.   They have revalidated their ORCA.

In reviewing the Federal Procurement Data System (FPDS) I have seen where this client has received two awards from the Department of Veterans Affairs for a total of $753,914. 


Rite-Way Lawn Care

Rite-Way Lawn Care is a sole-proprietor business in Greenville NC. They have been in business in NC since 2009 but with over 20 years in business in Ohio providing landscaping services. Rite-Way has primarily been focused on commercial mowing and residential lawn care. They have also provided services to the city of Greenville.

Cal Sherman, owner, was interested in getting certified for government procurement, particularly becoming pre-qualified for DOT work, to take his company to the next level. He contacted his local SBTDC office and was referred to the PTAC counselor in December 2009 about doing business with the government.

The PTAC counselor assisted Cal in completion of the DOT pre-certification paperwork. The owner contacted the counselor in March 2010, thanking her for her assistance and letting her know the company is now pre-certified with DOT to bid on contracts up to $300,000 and certified as a Small Business Enterprise (SBE) and able to bid on those contracts up to $500,000. Cal is also proceeding with other registrations and certifications to work with other government agencies.
